Introduction
The ownership of the mobile application and website www.nexte.app (hereinafter referred to as the “Platform”) is held by Nexte Sports SARL, a limited liability company (Société à Responsabilité Limitée) incorporated under Moroccan law, with its registered office located at Rue Soumaya, Immeuble 82, Étage 2, N° 04, Quartier Palmier, Casablanca, Morocco.
These General Terms and Conditions of Sale (“GTCS”) constitute a contract entered into between Nexte, accessible via its mobile application or website, and any natural or legal person using its services (the “User”). These GTCS govern all conditions of access, use, booking, payment, and management of the services offered by Nexte.
In addition by accessing or using the Platform, the user (hereinafter, the ‘User’) acknowledges that they have read, understood, and accepted these Conditions. Furthermore, they agree to any other applicable legal documents referenced herein, including the Privacy Policy, as well as any specific contractual provisions relating to individual services.
Article 1 – Purpose
The purpose of these GTCS is to define the terms under which Nexte provides a platform enabling the User to book sports match slots (football, padel) through its partner clubs.
Nexte acts exclusively as a technical and operational intermediary, and bears no responsibility for the organization of the pitches or the conduct of the activities.
Article 2 – Definitions
However for the purpose of these GTCS, the following terms shall have the meanings set forth below:
- “Application”: The digital platform published by Nexte, accessible via the website or the mobile app.
- “User”: Any natural or legal person using the platform to make a booking or perform any other action related to the services.
- “Client”: The User who has made a paid booking.
- “Partner Club”: The operator of sports fields approved by Nexte for the provision of match slots.
- “Services”: All functionalities offered through the platform, including booking, payment, and account management.
- “Contract”: All GTCS, booking confirmation, Privacy Policy, and any applicable special conditions.
CHAPTER II – REGISTRATION AND ACCOUNT CREATION
Article 3 – Access Conditions
Access to the Services requires the creation of a personal account by the User, composed of confidential login credentials.
Validation of the registration request constitutes full acceptance of these GTCS.
Article 4 – User Commitments
The User undertakes to provide accurate, complete, and up-to-date information and not to infringe on the rights of third parties.
The User is responsible for maintaining the confidentiality of their access credentials and for any action performed from their account.
CHAPTER III – BOOKING AND SERVICE PROVISION
Article 5 – Booking Procedures
Bookings are made exclusively through the Nexte platform, subject to availability.
Nexte reserves slots with Partner Clubs, forms teams where applicable, and guarantees the availability of the fields.
Article 6 – Acceptance and Confirmation
A booking becomes binding as a result of electronic confirmation following the User’s payment validation.
The confirmation constitutes the User’s firm contractual commitment.
Article 7 – Obligations of Partner Clubs
Partner Clubs are responsible for providing access to the field, ensuring compliance and safety, supplying necessary equipment, and welcoming players.
CHAPTER IV – PRICE, PAYMENT, AND BILLING
Article 8 – Prices
Prices displayed in the Application are in Moroccan Dirhams (MAD), all taxes included.
Prices may change over time but remain fixed for confirmed bookings.
Article 9 – Payment Methods
Payments are made through secure and encrypted channels, using 3D-Secure technology provided by Payzone (Vantage Payment Systems S.A.).
All transactions comply with PCI DSS security standards, ensuring the confidentiality and protection of Users’ payment information.
Cash deposit payments are also available through recognized partner networks, including Damane Cash, Barid Cash, Lana Cash, and Cash Plus, providing Users with convenient and secure local payment options.
Article 10 – Invoicing
An electronic invoice, compliant with Moroccan legislation, is issued and made accessible to the User after payment.
CHAPTER V – CANCELLATION, REFUND, AND CREDITS
Article 11 – Cancellation and Refund Policy
11.1 – Payment by Bank Card
- More than 15 hours before the match: full refund to the original payment method.
- Between 6 and 15 hours before: refund in the form of Nexte credits, credited to the User’s digital wallet.
- Less than 6 hours before: no refund.
11.2 – Payment by Nexte Credits
- More than 6 hours before: full refund in credits.
- Less than 6 hours before: no refund; the slot is released.
Article 12 – Refund Procedures
Refunds will be processed within a maximum of ten (10) business days from receipt of the request, via the same method used for the original payment.
Nexte does not issue refunds in cash or by bank transfer.
CHAPTER VI – RIGHT OF WITHDRAWAL AND LIMITATIONS
Article 13 – Right of Withdrawal
Consumer Users have a period of 14 calendar days to exercise their right of withdrawal, unless service execution has begun with their consent.
This right does not apply to professional Users, unless expressly stipulated otherwise.
CHAPTER VII – LIABILITY
Article 14 – Obligation of Means
Nexte shall take all reasonable measures to ensure the availability and security of the Application but cannot be held responsible for the safety or compliance of sports fields, which fall under the responsibility of Partner Clubs.
Article 15 – User Responsibility
The User must comply with the Club’s rules and safety instructions and is responsible for their own personal safety.
Article 16 – Limitation of Liability
In the event of fault attributable to Nexte, its liability shall be limited to the amount of the booking, excluding bodily injury or gross negligence.
CHAPTER VIII – PERSONAL DATA AND CONFIDENTIALITY
Article 17 – Privacy Policy
Personal data is processed in accordance with Moroccan GDPR-equivalent regulations and Nexte’s Privacy Policy, accessible in the Application.
The User may exercise their rights through the provided contact channels.
CHAPTER IX – AMENDMENTS, SUSPENSION, AND TERMINATION
Article 18 – Amendments to the GTCS
Nexte may amend the GTCS for legitimate reasons. The updated GTCS shall apply to all bookings made after their publication.
Article 19 – Suspension and Termination
Nexte may suspend or terminate the User’s account in the event of a breach of obligations, without prejudice to any claims for damages.
CHAPTER X – APPLICABLE LAW AND JURISDICTION
These GTCS are governed by Moroccan law.
In the event of a dispute, exclusive jurisdiction shall lie with the courts of Casablanca.
CHAPTER XI – MISCELLANEOUS PROVISIONS
Article 20 – Force Majeure
Neither Party shall be held liable in the event of an external, unforeseeable, and irresistible event making performance of the contract impossible.
Article 21 – Notifications
Electronic notifications sent to the address provided by the User shall be considered legally valid.
Article 22 – Confidentiality and Intellectual Property
All content of the Application is the exclusive property of Nexte or its partners.
Any unauthorized reproduction or use is strictly prohibited.
