1. Presentation of the Application

Nexte is a mobile application published by NEXTE SPORTS SARL, a limited liability company with a share capital of 100,000 MAD, registered under RC number 467199, with its registered office located at Rue Soumaya, Immeuble 82, 2nd Floor, No. 04, Quartier Palmier, Casablanca, Morocco.

The application allows users to book sports fields, particularly for football and padel, with partner clubs, create or join public matches, and connect with other players.

Use of the application implies full and unconditional acceptance of these Terms and Conditions of Use (CGU).

2. Definitions

  • Application refers to the mobile platform “Nexte” published by the above-identified company.
  • User means any person using the Application, whether registered or not.
  • Partner Club means any sports club that has entered into an agreement with Nexte to make its fields available for booking through the Application.
  • Non-Partner Club means any sports club, listed or unlisted in the Application, that has not entered into a commercial or technical agreement with Nexte, and for which bookings are made directly by the User outside of the Application.
  • Booking refers to the act by which a User reserves a field or joins a match through the Application.
  • Public Match means a match that is visible and open to all Users.
  • Service means all functionalities offered through the Application.
  • CGU refers to these Terms and Conditions of Use.

3. Nature of the Services

3.1 Partner Clubs

Nexte acts solely as a technical intermediary, enabling connections between Users and Partner Clubs.
When a User makes a booking through the Application, they enter into a direct contract with the relevant Partner Club for the actual provision of the service. Nexte is not a party to that contract and acts only as the platform provider and, where applicable, as the payment operator.

Partner Clubs are solely responsible for the availability and quality of the fields, the accuracy of published information, and the execution of the reserved service.

3.2 Non-Partner Clubs

When a User creates a public match using the option “I have already booked a field” for a Non-Partner Club, they act as the match organizer and declare that they have independently booked a field directly with that Club, outside the Application.

The organizer is responsible for the validity of the booking, the accuracy of shared information, and the proper conduct of the match.

To facilitate coordination, the organizer’s phone number is made visible to other Users on the match page.
By creating a public match through this feature, the organizer expressly consents to the display of their phone number to other Users.

Nexte is not a party to this booking, cannot verify its existence or validity, and cannot be held responsible for the absence of a booking, field unavailability, cancellation by the Non-Partner Club, or any incident occurring before, during, or after the match.

3.3 Bookings made outside the Application

Any booking made by phone, email, in person, or via another platform is governed solely by the terms agreed between the player and the Club, without any intervention or liability from Nexte.

4. User Account Creation and Management

Registration requires a real name, a valid email address, and a valid phone number.
Each User may create only one personal account.

The User is responsible for the accuracy and updating of their information. They may add a profile photo and access level and performance statistics.

Nexte may suspend or delete any account in the event of a breach of these Terms, suspected fraud, identity theft, or a security violation.

Account deletion may be requested at any time through the Application or by email at contact@nexte.app

5. Bookings and Cancellations

Cancellation policy for bookings made through the Application with online payment:

  • Payment by Bank Card:
  • More than 15 hours before the match: full refund to the original payment method.
  • Between 6 and 15 hours before: refund in the form of Nexte credits, credited to the User’s digital wallet.
  • Less than 6 hours before: no refund.
  • Payment by Nexte Credits:
  • More than 6 hours before: full refund in credits.
  • Less than 6 hours before: no refund; the slot is released.

Cancellation by the Partner Club:
The Club may cancel a booking due to field unavailability or a legitimate reason. The User may choose between a full refund to the original payment method or Nexte credits of equivalent value. Nexte will notify the User and may offer to reschedule.

Bookings paid directly to the Club:
Payments made in cash or under the Club’s own conditions are governed by that Club’s rules. Nexte is not involved in collecting or refunding such payments.

Notifications sent to the User:
Users may receive notifications for booking confirmations, cancellations, match reminders, player additions, result updates, friend requests, or match openings by a contact.

6. Conduct and Sanctions

Users must respect other players and Clubs, arrive on time for matches, and refrain from any offensive, discriminatory, or disruptive behavior.

In cases of repeated lateness, unjustified absences, inappropriate remarks, or violations of the CGU, Nexte may restrict or revoke access to the Service.

7. Personal Data Protection

Users’ personal data is collected and processed by Nexte, as the data controller, in accordance with Moroccan Law No. 09-08 on the protection of personal data.

The methods of data collection, processing, storage, and sharing, as well as Users’ rights, are detailed in Nexte’s Privacy Policy, available within the Application and at https://nexte.app/privacy-policy.

Use of the Application implies acceptance of this Privacy Policy.

8. Intellectual Property

The source code, interfaces, database, trademarks, logos, and all other content of the Application are protected under applicable copyright and intellectual property laws.

Any reproduction, modification, or distribution, in whole or in part, without prior written authorization, is strictly prohibited.
No rights are granted to the User other than a personal, non-exclusive, and non-transferable license to use the Application.

9. Force Majeure

Nexte shall not be held liable for any non-performance resulting from an unforeseeable, irresistible, and external event making execution impossible.
This includes major technical failures, internet outages, critical service provider disruptions, natural disasters, or government decisions.

10. Prohibited Commercial Use

It is strictly prohibited to resell or transfer a reserved slot through the Application or to use the Application to organize unauthorized paid events.

11. Partner Offers

Nexte may display promotional offers from partners within the Application.
Such display does not constitute an endorsement and does not alter the liability framework set forth in these Terms.

12. Liability

Nexte shall not be held responsible for injuries or incidents occurring in Clubs, for match cancellations by Clubs or players, for compliance with safety or health regulations within Clubs, for disputes between players, or for indirect damages such as loss of opportunity or profit.

Nexte is bound by an obligation of means regarding access to and operation of the Application.

13. Amendments to the Terms

Nexte may amend these Terms for legitimate reasons.
Users will be notified prior to the effective date. Continued use of the Service after that date constitutes acceptance of the new Terms.

14. Disputes and Governing Law

These Terms are governed by Moroccan law.
In the event of a dispute, the parties shall first seek an amicable resolution.
Failing that, the courts of Casablanca shall have exclusive jurisdiction.

15. Electronic Acceptance and Reference Language

The User accepts these Terms by performing a positive action within the Application (e.g., checking a box or confirming a prompt).
Proof of acceptance is securely retained by Nexte.

The reference language of these Terms and Conditions of Use is French.
